2. General information on data processing
2.1. Scope of personal data processing
We process the personal data of our users solely to the extent necessary to provide a functionally operational website, our content and our services. The processing of our users’ personal data is consistently carried out solely with the consent of the user. An exception applies in certain cases where prior acquisition of consent is not de facto possible and processing of the data in question is permitted on the basis of statutory provisions.
2.2. Legal basis for the processing of personal data
To the extent that we obtain the consent of the data subject for the processing of personal data, Art. 6 (1) (a) of the EU General Data Protection Regulation (GDPR) provides the commensurate legal basis.
With regard to the processing of personal data required for the performance of a contract to which the data subject is party, the commensurate legal basis is provided under Art. 6 (1) (b) GDPR. This also applies in respect of any processing steps required to undertake pre-contractual measures.
To the extent that processing of personal data is required for compliance with a legal obligation to which Horst und Gabriele Siedle Kunststiftung is subject, the commensurate legal basis is provided under Art. 6. (1) (c) GDPR.
In the event that the vital interests of the data subject or of another natural person require the processing of personal data, the commensurate legal basis is provided under Art. 6 (1) (d) GDPR.
Where processing is necessary to uphold the legitimate interests of Horst und Gabriele Siedle Kunststiftung or a third party and provided such interests are not overridden by the interests or fundamental rights and freedoms of the data subject, the commensurate legal basis for processing is provided under Art. 6 (1) (f) GDPR.
2.3. Data erasure and period of storage
Personal data pertaining to the data subject will be promptly erased or rendered unavailable upon the withdrawal of your consent or where the intended purpose of storage no longer applies. Storage may also occur where provided for by the European or national legislatures in Union directives, laws or other regulations to which the controller is subject. Data is also rendered unavailable or erased upon expiry of a storage period prescribed under the aforestated standards, save for where continued storage of the data in question is necessary for the conclusion of a contract or contract performance.
3. Provision of the website and creation of log files
Each time our website is accessed, certain user data are transmitted by the respective Internet browser and stored in log files, so-called server log files. This occurs in respect of the following data:

- Quantity of data sent

- Your operating system
- Your IP address
Such data are collected and processed for the purposes of enabling your use of our website (connection), ensuring system security, technical administration of the network infrastructure, provision of information to law enforcement authorities in the event of a cyber attack or misuse, and to optimise the services we offer. Subject to any applicable statutory or official retention obligations, these data are erased seven days after leaving our website. Legal basis for the collection, storage and use of these data is our legitimate interest in the unimpaired provision to you of the information on our website and ensuring the requisite security (Art. 6 (1) (f) GDPR.
Contact
Where you contact us via email, post or telephone, we will store and process your title, email address, name and the content of your communication. We will also store and process details of your first name, address and additional contact data where you provide such. Where you contact us using our contact form, we will collect, store and process your name, email address and the content of the message sent. This is mandatory information. You may also voluntarily provide us with details of your first name and/or telephone number and/or your preferred title. Please note that, in order to respond to your message, we do not require these data volunteered by you; please check carefully whether you wish to provide us with such. Subject to any applicable statutory or official retention obligations or the legitimate processing of data on an alternative legal basis, these data will be erased following conclusion of the communication with you. This will occur at the latest where we have had no further communication with you for one year. Legal basis for the processing of your personal data is our legitimate interest in communicating with you in response to your messages and for the purpose of answering your questions (Art. 6 (1) (f) GDPR). Where contact is undertaken for the purpose of concluding a contract, the additional legal basis for commensurate processing is provided under Art. 6 (1) (b) GDPR.
5. Newsletter
You may subscribe to our free newsletter. The newsletter provides you with information regarding our activities at irregular intervals. To send the newsletter by email we use the so-called double-opt-in process. Firstly, we will collect your email address. This is a mandatory requirement. You may also voluntarily provide us with your surname, first name and your preferred title. Please note that, in order to respond to your message, we do not require these data volunteered by you; please check carefully whether you wish to provide us with such. Such data are not required to order the newsletter.
After declaring your consent to receive our newsletter by clicking on the ‘Subscribe’ button on our website and providing your email address, you agree to us sending you a confirmation email to the email address provided, containing a link with corresponding instructions. Only after you have clicked on this link following your receipt of the email are we authorised to send you our electronic newsletter. Your consent and email address are therefore re-verified by means of your second action (clicking on the link). We will store and use your email address for the purpose of sending you our newsletter. By subscribing to our newsletter you have thus submitted the following declaration of consent, which is repeated below for your information:

The collection, processing and use of your data occurs exclusively in encrypted form using SSL encryption (so-called Secure Socket Layer) and/or TLS encryption (so-called Transport Layer Security), with the highest level of encryption respectively applied. SSL and TLS are used to encrypt the continuous data stream on the Internet between the server and a user's browser and consequently prevent ‘secret eavesdropping and reading’, insofar as technically possible. An encrypted connection is recognisable, amongst other things, by the fact that the URL is marked with ‘https://’ in the address bar of your browser and/or a ‘lock symbol’ or ‘key symbol’ (icon) appears at the bottom of the status bar in your web browser. Please note that data security cannot be fully guaranteed in relation to the use of email communication. For the communication of confidential information, the postal service or delivery by messenger may be preferable.
In addition, we use all reasonably suitable technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised third-party access. Our security measures are continually improved and further developed in accordance with technical advancements.
